
Kitutu Chache South MP Antoney Kibagendi has obtained anticipatory bail after moving to court to stop his arrest over an alleged assault incident captured on CCTV at a restaurant in Kisii.
Lady Justice Teresa Achieng’ Odera of Kisii granted the MP a Sh50,000 anticipatory bail, prohibiting police from arresting him pending further directions.
The orders were issued on December 2, 2025, following an application filed through Bonuke and Company Advocates.
The case stems from a complaint by Enock Omariba Moriasi, who reported to Kisii Police Station that he was assaulted on November 27, 2025, while having breakfast at a restaurant in the town.
A CCTV clip circulating widely on social media appears to show a man entering the establishment and approaching Omariba before a brief confrontation.
Speaking to journalists, Omariba claimed he was attacked and said he had completed all required procedures, including obtaining a P3 form.
His lawyer, Benard Atancha, questioned why no arrest had been made following the report.
“We have followed all the procedures, yet the police have not taken action,” Atancha said, noting that the matter had been formally recorded at the station.
The incident comes weeks after a heated exchange during a session of the National Assembly’s Health Committee involving MP Kibagendi and Health Cabinet Secretary Aden Duale.
During the session, the two clashed over committee matters, leading to a brief disruption of proceedings.
Both leaders accused each other of misconduct, with Committee Chair James Nyikal intervening several times to restore order.
At one point, Kibagendi alleged bias in how the session was being handled.
Nyikal rejected the claim and insisted he remained in control of the meeting.
The MP was later escorted out after declining to yield the floor.
