A Nairobi court has ordered the filing of a pre-bail report before setting bond terms in a Sh200 million land fraud case, while lifting an arrest warrant earlier issued against one of the accused.

Joshua Kimaita Kirera and his co-accused, David Omondi Opondo, are facing charges of conspiring to defraud Pinnacle Business School Limited of 8.6 hectares of land in Ngong in 2017 through fraudulent documents.

Kirera is also accused of perjury for allegedly giving false testimony that facilitated the transfer of the disputed property to Super Drill International Limited.

He faces additional counts of forging a loan agreement dated December 30, 2014, uttering a forged affidavit, making false documents, and attempting to transfer the land using fake papers.

Appearing before Senior Principal Magistrate Dolphina Alego at the Milimani Law Courts, Kirera denied all the charges.

His lawyers argued that both accused have complied with police directives and are not flight risks. They also noted that Kirera is already out on a High Court bond and urged the court to grant them personal bonds.

Opondo, who had failed to appear in court on September 8, leading to a warrant of arrest, had his lawyers explain that he was admitted to the hospital at the time. They asked the court to lift the warrant.

The prosecution did not object to bond but urged the court to impose strict terms reflecting the gravity of the charges. It also requested a two-week mention to allow time for supplying documents to the defence.

Magistrate Alego accepted the explanation for Opondo’s absence, lifted his arrest warrant, and set the matter for mention on September 15, when the pre-bail report will be presented.
