In Courts: Direction to be issued in case challenging Supreme Court ban on lawyer Ahmednasir

The High Court is today expected to issue directions in a petition filed by the Law Society of Kenya (LSK) contesting the Supreme Court’s decision to bar Senior Counsel Ahmednasir Abdullahi and lawyers associated with his firm from appearing before it.

In the petition, LSK argues that the Supreme Court acted outside its constitutional mandate, violated the right to a fair hearing, and undermined legal representation rights protected under Article 50 of the Constitution.

The society further contends that such administrative sanctions against advocates lie within the mandate of the Advocates' Complaints Commission and the Law Society’s disciplinary processes, not the courts.

LSK seeks orders declaring the Supreme Court’s actions unconstitutional, null, and void, and a finding that judges of the apex court remain bound by the Constitution like all other public officers.

Today’s directions by Justice Chacha Mwita are expected to set the pace on how the court will handle the matter moving forward.

Ojwang case: Former OCS Talaam back in court

Elsewhere, the case involving former Central Police Station OCS Samson Talaam is set to resume today at a Nairobi court, with focus still lingering on his confiscated mobile phone.

While Albert Ojwang's murder case has since been transferred to Kibera Law Courts for trial, proceedings in Milimani persist due to a separate investigation into a SIM-swap fraud linked to his phone.

The phone, which had been seized by IPOA upon Talaam’s arrest in connection with the case, was later allegedly used by a suspect to impersonate Talaam and extort money from his family and legal team.

On July 21, a magistrate court allowed detectives to continue holding Kiprotich Ronoh Brian, a suspect linked to the alleged fraud, as investigations continue into how the phone fell into criminal use while under IPOA custody.

Elijah Ochora's hearing

In another case, Elijah Ochora is back before the court as the hearing of charges against him is set to begin.

The young author is facing charges for allegedly posing as Charlene Ruto with the intent to defraud the public, under the trade name Zawadi Publishers, according to the charge sheet.

The offence is alleged to have occurred on or before May 22, 2025.

At his initial appearance in June, Ochora pleaded not guilty, and the court released him on a Sh50,000 cash bail.
