Court gives DPP last chance to supply evidence in Sh356m fraud case

Court ordered the prosecution to provide all documentary evidence and materials to the defence

The court has directed the Director of Public Prosecutions (DPP) to supply evidence it intends to rely on in a Sh356 million fraud case within three days.

Milimani Senior Principal Magistrate Dolphina Alego ordered the prosecution to provide all documentary evidence and materials to the defence by Thursday, warning that her court would not tolerate further delays.

The accused, Honey Khatwani, was arraigned last month and charged in connection with the alleged theft of Sh356 million from his employer, OKI General Trading Limited, in Baba Dogo, where he serves as a director.

When the matter came up for mention on Monday, Khatwani’s lawyer, Kennedy Echesa, told the court the prosecution had not yet supplied any of the evidence it intends to present at trial.

“The defence has not been furnished with any evidence despite the charges being filed weeks ago. We urge the court to compel the prosecution to comply,” Echesa said.

Prosecutor Victor Awiti confirmed that the documents would be availed but requested additional time to finalise preparations.

Magistrate Alego, however, stressed that Thursday’s deadline would be the final opportunity for the prosecution to comply.

Khatwani is out on cash bail of Sh5 million.

The case will be mentioned again on July 10, 2025, for confirmation of compliance and further directions.
