High Court bars ICT Authority Board from terminating CEO's contract

The High Court in Nairobi has issued temporary orders barring the ICT Authority Board from terminating the employment of its Chief Executive Officer, Stanley Kamanguya.

The orders, issued by Justice Nduma Nderi, are in place pending the hearing and determination of a petition filed by Kamanguya.

"Meanwhile, an injunction is issued restraining the Board from discussing the matter of reappointment of the petitioner pending the hearing and determination of this application," reads part of the directive from the Employment and Labour Relations Court.

Kamanguya states that on March 6, the Board of Directors approved and recommended his reappointment as CEO to the Cabinet Secretary for ICT and the Digital Economy, for a new term starting August 8, 2025.

He says the Cabinet Secretary formally reappointed him on March 10, based on the Board’s recommendation.

However, the Board later issued a notice for a special meeting scheduled for July 1, 2025, to deliberate on the reappointment.

Kamanguya maintains that the reappointment was lawful and had been endorsed by the relevant authority.

He argues that any attempt to reverse the decision undermines due process and interferes with a matter already before the court.

He further contends that there is an ongoing case on the matter, which should be concluded before any further action is taken.

“The question concerning the Petitioner's re-appointment as the CEO of the ICT Authority is pending hearing and determination by this Honourable Court in Nairobi ELRC Petition No. E079 of 2025, Brian Hori & Victor Okoth v Ministry of ICT & Digital Economy & Others,” he states in court filings.

“Notwithstanding the pendency of the said dispute before the Court, the 2nd Respondent has issued a Notice of a Special Board Meeting scheduled for Tuesday, 1st July, 2025 at 9:00 a.m. for purposes of discussion of agenda item concerning the Minutes of the Board of Directors of the 1st Respondent concerning the re-appointment of the Petitioner as the CEO of the 1st Respondent.”

The case is scheduled for hearing on July 7, 2025.

On Tuesday, the ICT Authority Board formally revoked Kamanguya’s reappointment, citing concerns over the procedure followed during the renewal process.

The Board indicated that Kamanguya’s application for renewal, dated February 6, 2025, was received after the six-month deadline set out in public service guidelines.

It further stated that the March 6 meeting in which the renewal was approved had been adjourned and was reconvened without proper notice.

The Board also noted that the renewal proposal was prepared by Kamanguya, rather than by a special committee that would ordinarily conduct a performance evaluation.
