Court stops Governor Guyo’s ouster until case before it is concluded

The High Court in Isiolo has temporarily halted the impeachment proceedings against Isiolo Governor Abdi Ibrahim Guyo, just a day before the County Assembly was set to debate a motion seeking his removal from office.

Justice Nyaga Heston Mbogo issued a conservatory order on Monday, restraining the County Assembly and its members from processing or debating the impeachment motion until the case filed by Governor Guyo is heard and determined.

“I am satisfied that the applicant has made out a case that warrants the grant of the relief sought,” ruled Justice Mbogo.

“Pending the hearing and determination of this application inter parties, a conservatory order is hereby issued restraining, barring, and or preventing the respondents from admitting, processing, debating, or considering the Notice of Motion dated June 10, 2025.”

The impeachment motion had been tabled on June 9 by Sericho Ward MCA Abubakar Godana, with a heated debate scheduled for Tuesday, June 17. The motion has already garnered support from 16 out of 18 Members of County Assembly (MCAs), indicating strong momentum in favour of the governor's removal.

In his ruling, Justice Mbogo also directed that Godana serve Governor Guyo with the Notice of Motion for impeachment, along with all supporting documents, within 48 hours.

Respondents are required to file their responses within seven days, and the matter is scheduled for a compliance and directions hearing on June 30, 2025. 

Godana’s motion lists several accusations against Governor Guyo, including abuse of office, gross misconduct, and financial mismanagement.

Specific allegations include: Oversight of multiple stalled development projects, failure to meet county revenue targets, hiring of 36 advisors, exceeding the legal limit of four set by the Salaries and Remuneration Commission, illegal appointment of two Deputy County Secretaries and intimidation of county staff.

The MCA further argues that Guyo’s conduct constitutes a breach of Chapter Six of the Constitution, the Leadership and Integrity Act, and the Public Officers’ Ethics Act — laws that mandate ethical leadership, accountability, and good governance.
