There's insufficient evidence to charge Kelvin Moinde, says DPP

The Office of the Director of Public Prosecutions (ODPP) has confirmed receiving an inquiry file concerning social media user Kelvin Moinde.

In a statement issued on Monday, the DPP said there was insufficient evidence to warrant charges against Moinde.

“Upon careful perusal of the inquiry file, the Director of Public Prosecutions (DPP) is satisfied that there is no sufficient evidence to charge Kelvin Moinde,” the statement read.

“The ODPP remains committed to executing its constitutional mandate in accordance with the law, the public interest, and the administration of justice.”

Moinde was reportedly arrested in connection with an online post.

Kenyans on social media have raised concerns about his whereabouts and arrest.

They have called for Moinde’s release and for the protection of freedom of speech.

This comes at a time when Kenyans are seeking answers regarding the death of social media user Alfred Ojwang.

He was arrested at his home in Homa Bay on Saturday, June 7.

Following his arrest, he was booked at Mawego police station, then transferred to DCI headquarters in Nairobi.

Police stated that Ojwang banged his head against a wall.

Ojwang died in police custody, and a post-mortem examination was scheduled for Monday, June 9.

Police said Ojwang was found with serious head injuries believed to be self-inflicted and was rushed to hospital, where he was pronounced dead.

Ojwang had travelled to Homa Bay town to visit family when he was picked up by police officers.

He was driven to Nairobi and booked at the police station for further questioning.

Leaders, Kenyans, and civil society groups have condemned Ojwang’s death and called for a thorough and speedy investigation.

On Monday, a lawyer representing Ojwang's family raised concerns over the condition of his body, pointing to visible signs of physical trauma.

Speaking outside City Mortuary, the lawyer stated that Ojwang’s body had extensive injuries to the head, hands, and shoulder area.
