
Homa Bay Town MP Peter Kaluma has questioned former Chief Justice David Maraga’s decision to appear in court in support of civic activist Rose Njeri on May 3, 2025.
Njeri was released on a Sh100,000 personal bond pending a ruling on whether she will be charged with unauthorised interference with a computer system.
Milimani Magistrate Geoffrey Onsarigo set June 20, 2025, as the date for the ruling on whether Njeri will take a plea to the charges.
According to the charge sheet, Njeri is accused of unauthorised interference with computer systems, contrary to Section 16 of the Computer Misuse and Cybercrimes Act.
She was accompanied to court by a team of prominent lawyers, including Maraga, Senior Counsel and former Vice President Kalonzo Musyoka, and Senior Counsel John Khaminwa.
Maraga told the court that Njeri was arrested on Friday, May 30, specifically to keep her in custody over the long weekend.
“The police didn’t need to arrest her; they just needed to call and inform her they intended to prefer charges,” the former CJ said.
“Being arrested on a Friday, knowing very well that Monday was a public holiday, was just meant to torture her. We pray, Your Honour, that you release her forthwith.”
In a statement on Wednesday, June 4, Kaluma expressed concern over Maraga’s involvement in the matter, suggesting it could affect perceptions of the former CJ’s legacy.
Kaluma also reiterated his call for the government to create avenues for the continued engagement of retired senior officials.
“As I’ve said before, we must find a way to ensure retired heads of government arms remain meaningfully engaged,” he said.
Maraga, who has declared his 2027 presidential bid, has been traversing the country to popularise his ambitions.
He is expected to announce the political party he will use for his campaign in the coming months, as he seeks to succeed President William Ruto.
