
The High Court has barred four police officers charged with the murder of Baby Pendo and other protesters from setting foot in the hotspot areas of Kisumu where the victims reside.
Justice Margaret Muigai on Monday ordered John Chengo, Linah Kogey, Cyprine Robi and James Rono not to set foot in Nyalenda, Obunga, Nyawita and Nyamasaria estates of Kisumu.
The orders followed an application by victims’ lawyer
Willis Otieno, who said the accused should be barred from making any contact
with victims.
The four police officers were last week charged with the murder of a six-month-old baby Samantha Pendo in October 2017.
Eight other officers who had originally also been accused alongside the four have had the charges against them dropped by the Director of Public Prosecutions who citing lack of evidence.
Baby Pendo was fatally hit in 2017 as police officers were deployed to quell violence linked to the 2017 post-election protests in Kisumu.
Last week, Chengo, Linah, Robi and Rono denied multiple charges, including murder as a crime against humanity.
They also pleaded not guilty to other charges of torture and rape committed against civilians.
The DPP has not opposed their request to be released on bail.
The four are out on Sh200,000 personal bond each pending the court’s ruling on bail/bond.
Justice Muigai ordered that a pre-bail report be prepared in two weeks to enable the court to make an appropriate decision.
The case will be mentioned on May 28.
