Four cops charged with murder of Baby Pendo, ODPP clarifies

The officers were charged with multiple counts of crimes

Four senior police officers have been charged with the murder of Baby Samantha Pendo at Milimani Court.

Baby Pendo died in 2027 after she was hit by a blunt object as anti-riot police officers pursued protesters in their compound. 

The officers were charged with multiple counts of crimes against humanity, including murder, rape and torture.

The four appeared before Justice Margaret Waringa Muigai and pleaded not guilty to one count of murder, 11 counts of rape and 38 counts of torture.

The case will be mentioned on May 12, 2025, for further directions.

In a statement, the Office of the Director of Public Prosecution said Inspector John Chengo Masha and Inspector Linah Kosgey were charged with the murder of Baby Pendo and an alternative charge of failing to refer the matter for investigation and prosecution.

They were charged with rape, and alternative charge of failing to prevent or suppress widespread acts of sexual violence against civilian women, torture and failing to submit these matters to competent authorities for investigation and prosecution.

Robi Wankio was charged with rape, and alternative charge of failing to prevent or suppress widespread acts of sexual violence against civilian women; Torture and failing to submit these matters to competent authorities for investigation and prosecution.

James Rono was charged with Rape, and alternative charge of failing to prevent or suppress widespread acts of sexual violence against civilian women; Torture and failing to submit these matters to competent authorities for investigation and prosecution.

DPP directed that the eight officers record statements as prosecution witnesses.

“The Office of the Director of Public Prosecutions (ODPP) remains committed to executing its constitutional mandates in accordance with the Rule of Law, Public Interest and the administration of justice,” the statement read.
