Man in court for allegedly stealing Sh5,500 school property

In mitigation, the accused pleaded with the magistrate not to further hold him in custody

A man who allegedly stole school property worth Sh5,500 to raise money to feed himself has been arraigned before a Kabarnet court and charged with stealing.

The man is accused that on March 3, at about 6 pm at Kabarnet town in Baringo Central, he allegedly stole a metallic bucket and a metallic tube bar that were all valued at Sh5,500, the property of a high school.

He faced an alternative charge of dishonestly handling stolen property contrary to section 322 (1) (2) of the penal code.

When he appeared before Senior Principal Magistrate Purity Koskey, the accused who was charged with stealing contrary to section 268(1) as read with section 275 of the penal code admitted committing the offence.

“Your honour, it is true I intentionally stole the items to sell the property to raise some money to feed myself because I was hungry,” he said.

In mitigation, the accused pleaded with the magistrate not to further hold him in custody while appealing to be sentenced to a community service order.

Koskey in her ruling ordered the accused convicted on his own plea of guilty to continue being held in custody until March 20 when the case will be mentioned.

On the mentioned date, the magistrate stated, the court will rule whether the accused will be given a community service order sentence or not.
