Court to rule on Italian application on Kirima land April

The High Court will on April 18 rule on whether it will issue temporary orders preserving the contentious Kirima Njiru land pending the determination of a suit filed by an Italian family laying claim over the same property.

Environment and Land Court Judge Lucy Mbugua said she will give a ruling on the said date regarding the amended application dated 11 January this year.

As the ruling pends, the Kirima family were granted time to file their responses in the case by March 4.

Bernado Vicezo De Masi in his court papers claims that the land belongs to his late father Dominico De Masi.

Bernado claims to have crucial evidence and information to support the ownership.

His case comes after the court gave the land's ownership right to the family of Kirima in December last year.

The judgment was issued by Environment and Land Judge Samson Okong’o, who gave the squatters up to December 31, to vacate and hand over possession of the property to the estate of Kirima.

Vicezo, however, said they were not aware of any sale or lease to the Kirimas and were shocked by the judgement issued on October 23.

They argued that the De Masis had not been made aware of the suit or the dispute over the land.

Embakasi East MP Babu Owino on Monday urged residents in the Kirima land in Njiru not to transact with any parties to the land until the court gives its final decision.

Embakasi East MP Babu Owino who was present in court later told the Press that they would pursue the case to its logical conclusion to ensure residents get the justice they deserve.

He urged residents of Kasarani to await the decision of the court with the hope that it would be in their favour.
