Miguna defends Mudavadi's office, says it's within law

He added that the word 'Prime' does not make it a prime minister's office.

Lawyer Miguna Miguna has defended the position of the Prime Cabinet Secretary saying that it is within law.

He said this while responding to a Twitter user who asked about the position. 

According to Miguna, the Prime CS job falls within the constitutional limit of 22 CSs.

He explained that the name Prime does not give it any special consideration.

"Musalia Mudavadi holds a prime cabinet position, which is one of the 22 slots permitted by the Constitution. The title “prime” is similar to the title “treasury” for the cabinet secretary for finance. Nothing unusual or unlawful there," Miguna stated.

"Kenya is a pure presidential system. The president is the head of state and government. So, titles given to cabinet secretaries don’t change the structure of government in place in Kenya."

He added that the word 'Prime' does not make it a prime minister's office.

Miguna further noted that the confusion with the office of PM comes from the roles given to Mudavadi's office.

"It’s not a Prime Minister’s Office. If it were, then in line with well established governance structures all over the world, he would have been the “head of government”... I believe a lot of Kenyans are confused because of his role as the “coordinator” of government functions, which some people mistakenly believe is reserved for a prime minister. It’s not," he said on Friday.

This comes even as the Kenya Kwanza administration plans to have the office embedded in law.

The office of the Prime Cabinet Secretary was created by Executive order No. 1 of 2023 by president William Ruto.

According to chapter nine, article 152 of the Kenyan Constitution, "The Cabinet consists of the President; the Deputy President; the Attorney-General; and not fewer than fourteen and not more than twenty-two Cabinet Secretaries."
