Aloise Kinyanjui, the younger brother of Trade CS Moses Kuria has filed a notice to withdraw an election petition that he challenged the re-election of Juja MP George Koimburi.
In his court papers, lodged at the Kiambu High Court, Kinyanjui, who vied for the Juja Parliamentary seat on a Jubilee ticket told Justice Roselyn Wendo that he wants to withdraw the petition to allow for the Cohesion, healing and development of the people of Kiambu
The businessman made the application for withdrawal after reaching consent with Koimburi of the UDA party who won the Juja parliamentary seat after garnering 39,413 votes.
"The petitioner applies for leave to withdraw the petition upon consent was entered between the petitioner and the respondents," Court papers read.
Justice Wendo will tomorrow rule on whether she will allow the application for withdrawal.
In court papers, Kinyanjui wanted the court to invalidate Koimburi's win saying the whole election for the parliamentary seat was not fair and transparent.
Through lawyer Geoffrey Omenke and Njiru Ndegwa, he had argued the entire election for the parliamentary seat, which was overseen by the Independent Electoral and Boundaries Commission (IEBC) on August 9, was marred with massive irregularities and illegalities, and that the same should be nullified.
In the case, Kinyanjui declined to concede defeat following the announcement of the final results.
He has sued IEBC, the Juja constituency Returning Officer and MP Koimburi who are all listed as respondents.
However, following the withdrawal, the High Court is expected to have it thrown out.
