The Kenya Revenue Authority (KRA) is considering settling the Sh2.5 billion tax evasion case facing businesswoman Mary Wambui and her daughter out of court.
Prosecution counsel Judy Thuguri told Anti-corruption Magistrate Felix Kombo that they received a letter on September 14 from the counsels of the accused persons requesting a review of the case on the basis of new information.
The office of the DPP subsequently wrote to KRA on September 29 seeking their views.
Thuguri told Kombo they received a response on October 6 from KRA indicating they had been in engagements with the accused persons.
The engagements revolved around a review of tax payable which has been contested by the accused persons.
"There are out-of-court settlements being considered. Our part we had not had time to seek directions from DPP on how to proceed with the matter considering this new development," said Thuguri.
The prosecutor told the court since they got the response from KRA, they are yet to seek directions from the DPP on how to proceed.
She asked the court to grant them a mention date to allow them considerable time to seek directions from their boss.
The matter was fixed for December 5 when the court will give further directions.
At the same time, the passports of the two accused persons were temporarily released for travel and renewal purposes.
