Benson Amhoye Shirumba is accused of defiling a 14-year-old. He did not even mitigate after being found guilty.
Kibera senior principal magistrate Charles Mwaniki on Tuesday said the prosecution proved its case against Amhoye but he failed to be remorseful and instead remained arrogant.
“I have considered your side of the story and the prosecution's case. I therefore sentence you to 20 years in jail,” he ruled.
Shirumba is accused of defiling PQ on December 15, 2020 at Raila slums, contrary to the Sexual Offences Act.
He was charged with the second count of committing an indecent act with the child, contrary to the law.
The prosecution had during the trial called several witnesses who testified against the accused.
While testifying in court the minor narrated how the accused defiled her, saying he found her playing with her friends.
“My school is Uhuru Garden and I am in Class 6. On that day, I had gone to see my friend at around 1pm,” she told the court.
The minor said she was playing football with her friend QR before she met the accused person on her way home.
"He told me while I was at the gate that he was lucky to find me,” she said.
The child told the court that she wanted to scream but the accused person covered her mouth and led her to his house, where he defiled her.
“He pushed me to his house and I hit a stool. He came above me and put his mouth over my mouth, he had by then put off the lights.
"He threw me to his bed later and undressed me before he defiled me. I cried out for help but all was in vain. He forced me to have anal sex with him too and I started bleeding,” the girl told the court.
She said later after the incident and the accused person had left, she met the chief’s wife.
The minor said the chief’s wife asked her why she was crying and she narrated to her what had occurred.
She said the woman took her to the chief who recommended that she be taken to the hospital, which she did.
“I went to Otiende hospital and later to another where it was confirmed that I was sexually abused,” the minor said.
She said the accused person was later arrested after the matter was reported to the police.
