What I'll do if Supreme Court rules in favour of BBI - Kuria

"The problem with BBI was never the substance; it was the process," Kuria said.

In Summary

Gatundu South MP Moses Kuria has said that he will be at the forefront of pushing for the Building Bridges Initiative (BBI) report if the Supreme Court rules in its favour.

In a statement on Thursday, Kuria said the constitutional amendment drive's only fault was the process, and not it's content.

"The problem with BBI was never solely the substance, it was the process. The net effect of the Supreme Court ruling today will be a remedy to all the process maladies," he said.

"If the SC rules in favour of BBI, that will cleanse the process. I will be at the forefront in pushing for immediate implementation."

His remarks come just hours before the expected BBI ruling by the apex court.

The initiative was stopped by the High Court and the Court of Appeal, where it was termed null and void.

Supreme Court registrar Letizia Wachira on Monday announced that the court would deliver judgement on the Building Bridges Initiative on Thursday, March 31.

The highest court in the land is set to determine at least seven key issues raised by the lower courts, while they nullified the entire process.

They include; if the basic structure applies in Kenya, if the President can start a popular initiative law review, and if he can be sued at a personal capacity.

The Supreme Court will also determine whether the Independent Electoral and Boundaries Commission was properly constituted when it approved the Bill, and whether the proposed new 70 constituencies are legal.

The court will give direction on whether a referendum ballot paper should have one or multiple questions and if the BBI complied with the participation threshold.
