Devolution Principal Secretary Julius Kiplagat Korir has been summoned to appear before a Nairobi court to be charged with assaulting a woman.

Milimani Chief Magistrate Susan Shitubi summoned the PS after the prosecution applied to have him summoned over the assault case.

“We apply for summonses against the accused through the investigating officer to appear in court and plead to the charges," the prosecution told the court.

Korir is set to appear in court on February 10.

In the charge sheet filed in court, Korir is accused of unlawfully assaulting Everlyn Koech and occasioned her bodily harm.

He is alleged to have committed the offence on September 17, 2020, at Ndalat Road Karen in Nairobi.

Last year, Korir had moved to the High Court to stop his prosecution, but Justice Anthony Mrima, in November 2021, dismissed the petition on grounds the State was right in mounting prosecution against him with the offence of assault and injuring Evelyn Koech while she was pregnant.

He had sought to stop the Director of Public Prosecutions (DPP) and the Directorate of Criminal Investigations (DCI) from arresting and prosecuting him in connection with the offence, terming it as illegal, in bad faith and infringement on his constitutional rights.

“The petitioner has not shown how the DPP violated the Constitution by authorising his prosecution. Further, if the court quashes or grants the orders sought, it will frustrate the rule of law,” Justice Mrima ruled.
