Mutunga blasts government over blocking Miguna's return

Former Chief Justice Willy Mutunga has lashed out at the government for blocking lawyer Miguna Miguna from travelling back to Kenya.

Mutunga Tuesday said the government was acting in total impunity by issuing red alerts to airlines.

“That level of impunity from the principal legal advisor to the Government of Kenya should worry every Kenyan,” Mutunga said.

In a tweet on Monday, Miguna said he had been blocked from boarding Air France and land in Kenya on Tuesday 16.

He was informed about the new development at the Berlin Brandenburg Airport in Germany.

Mutunga noted that the government has repeatedly ignored court orders.

He also expressed his distrust in Attorney General Kihara Kariuki who previously informed the courts that there were no red alerts.

The former CJ committed to ensuring Miguna Miguna jets back to the country.

“As United Progressive Front, we shall fight to ensure that all orders that come from the judiciary are respected and enforced,” Mutunga said.

Mutunga spoke during a press conference held by the United Green Movement, the Communist Party of Kenya, and the Ukweli Party.

He dismissed claims that he was taking part in helping Miguna for political gain.

The official carrier of the French Republic; Air France was faulted for taking part in what they termed as a violation of human rights.

“The Government of France should direct its airlines to disregard such kinds of alerts in future,” he added.

The lobby groups committed to going to court once again to ensure Miguna is allowed back to the country.

Law Society of Kenya President Nelson Havi asked political aspirants to ensure human rights are not violated.

He faulted most presidential aspirants for focusing on economic models and not the Constitution, Democracy, and Human Rights.

According to Miguna, the alert was issued on Monday morning to the carrier not to fly him to Nairobi.

Miguna had booked an air ticket to travel from Canada via Germany and France to land in Kenya on November 16, 2021.

He said his flight was scheduled to land at the Jomo Kenyatta International Airport (JKIA) on Tuesday at 9 am.

The new development comes after the High Court on Friday declined to lift the red alerts issued by the government against Miguna to travel to the country.
