An Embu businessman has appealed against a court order that he demolishes his storeyed building on a grabbed plot and compensates the owner with Sh43 million.
The Environment and Land Court in July ordered Njue Kiarie and his wife Janet to pull down part of their Morning Glory Plaza in the heart of Embu Town.
Judge Yuanis Agima said the land on which the building stands belongs to Cosmas Kathungu.
The Kiaries had 60 days to bring down the building and compensate Kathungu, who had protested the encroachment of his land on February 28, 2000.
The judge said that if the Kiaries do not demolish the building, then Kathungu should do so at the cost of the former.
