Mombasa Nakumatt served eviction notice

The High Court in Mombasa ordered that Nakumatt vacates from City Mall building due to rent arrears.
Judge Charles Yano said Nakumatt should leave the premises after failing to pay rent, service charges and promotion fund worth Sh27.8 million.
In his ruling,judge Yano said owners of the mall,Ideal location limited are at liberty of evicting the much touted chain of supermarkets.
The judge further ordered the supermarket to pay all outstanding balances and payments accrued at the date of eviction. Nakumatt failed to defend themselves from the allegations. Yano said since the supermarket had not contested the allegations,the motion by the landlord was allowed.
In the application dated November 23, Ideal wanted the court to declare Nakumatt and Atul Shah, also a defendant in the matter, to have breached a lease agreement.
