Mark Too family demand payment from lawyer Lilan over burial case

The family of the late Mark Too now want lawyer Simon Lilan to cover costs for a case he filed seeking to block the former MP's burial.

Lilan went to court demanding an independent probe into the death of the former nominated MP, claiming he may have been assassinated because of politics and his vast wealth.

He sued Too's widow, Kapseret MP Oscar Sudi, Lee Funeral Home and the Attorney General but the High Court lifted an injunction he obtained leading to the burial on January 9.

Too collapsed at his home in Eldoret on December 31 and was rushed to St Luke’s Hospital, where he was pronounced dead.

The late MP's family through lawyer Steve Biko said they were dragged into the court unnecessarily.

"All those he sued did not come to court for merry making. They camé because he had sued them and they incurred costs," Biko said.

But Lilan's lawyer Morgan Omusundi told Eldoret magistrate Harrisson Barasa that the family did not deserve to be paid costs.
