Records show that Sakaja did not complete his Bachelor's degree in Actuarial science at UON, a course he enrolled in 2003.
It is unclear why he then switched courses and moved across the borders to study a Bachelor of Science in Management degree.
On Tuesday UoN edited its website three times before finally dropping Sakaja's name from the hallowed “notable alumni” list.
He had been listed as an alumnus of the university, Faculty of Science and Technology, having joined the institution from 2013 to 2016.
His rivals executed a meticulous background check on his undergraduate studies which exposed the glaring gaps before pouncing on him.
The Senator now has his fingers crossed as he awaits the conclusion of a case challenging his academic documents before the IEBC tribunal.
He will only be hoping that all goes well when the three-member committee chaired by George Murugu handling the case delivers judgment on June 19.
On Wednesday night, the UDA candidate who is battling a myriad of challenges threatening to cripple his political career succeeded in having two supplementary affidavits rejected which if admitted would have been used to nail him.
In the affidavits, Dennis Kaguu, the sole complainant, wanted the committee to consider the report from the Commission of the University of Education revoking Sakaja's degree certificate from Team University in Uganda.
In his ruling, Murugu, who is in the panel made up of IEBC vice-chairperson Juliana Cherera and Boya Molu, rejected it on the grounds, “No one had applied for the leave even though served with the same.”
Armed with a battery of lawyers, who included Senator Kipchumba Murkomen, Sakaja told the panel that it was wrong for the complainant to adduce new evidence not captured in the complaint.
The documents were submitted by Njoki Mboche, one of the lawyers representing Kaguu.
“When a party approaches court, they put in place all the documents in such a manner that a respondent invited to the matter will know exactly what it entails hence prepare well for it.
“What we are witnessing today is trial by ambush, where a party seeks to reinvent a case by introducing a new course of action not previously captured in the complaint, so we will be disadvantaged.”
A relief had earlier come for Sakaja when three other complaints lodged by Elizabeth Nzisa, Evans Kaita and Alex Abere were dismissed after they failed to make appearance in the court.
It is, however, the inconsistency on his qualifications, shadowy education path and background that is likely to cost the 37 year-old the successful career he has built since appointed as President Uhuru Kenyatta’s TNA party.
While the panel may not use the evidence that his degree certificate is unrecognized in Kenya in giving its final verdict, it leaves a doubt on the face of many Kenyans and interested parties on whether he was qualified to be cleared as required by law or not.
On June 14, the University of Nairobi removed Sakaja name on the list of alumnus in the Faculty of science and technology hours after updating it.
The listing of the senator came after allegations emerged that pages of the graduation list had deliberately been omitted.
The University had stated that he graduated with a degree in Actuarial Science and that at the institution he set up a financial consultancy firm, Arthur Johnson Consultants, during his fourth year.
Sakaja, in the court papers, is also disputing the name Koskei as indicated by the complainant, arguing he is referred to as Arthur.
“Your honor if we were to look for some by the name Johnson Koskei Sakaja, that person has not been cleared by IEBC. The one who was cleared is Johnson Arthur Sakaja,” said Mutuma.
Nairobi County returning officer Albert Gogo defended his decision to clear the candidate, having confirmed all the documents were in order, it was not upon him to establish its validity.
Gogo, through lawyer Moses Kipkogei, argued that the burden of proof to confirm the allegations of the invalidity of the certificate lies on the complainant and should not be shifted.
