An Anti-Corruption Court on Monday directed a graft case where former Kasarani MP Elizabeth Ongoro and her husband are charged with embezzlement of Sh43 million from the Kasarani constituency development fund to be mentioned on October 3.
This is after the new trial magistrate said that she was not sitting.
The case had come for a mention to fix a hearing date.
Senior principal magistrate Eunice Nyutu directed the parties to appear before trial magistrate Zipporah Gichana who will fix a hearing date.
Magistrate Gichana took over the case after Magistrate Peter Ooko was transferred to another station.
In the case, 15 prosecution witnesses have so far testified and according to the prosecution, about 20 witnesses are remaining to give their testimony.
Ongoro is charged alongside her husband Ferdinand Masha Kenga and eight others.
They allegedly committed the offence between May 2008 and December 31, 2012, in Nairobi.
The funds were meant for the construction of Kasarani Girls High School.
The other suspects are James Dola, Silvan Onyango, Pamela Achola, William Ogutu of Nyangina Enterprises, Maurice Odhiambo of Komala Constructions, Jecinta Opondi and Accurate Construction and Engineering Works Limited
They are each out on Sh3 million cash bail pending the hearing and determination of the case.
Earlier, the accused persons were charged afresh after the trial court allowed the prosecution to adduce more evidence and call seven more witnesses in the case.
In his ruling on April 12, the magistrate said after analysing both submissions from the prosecution and objection by the defence, he found the application merited.
