The Speaker of the Taita Taveta County Assembly has been handed relief after the Voi High Court temporarily stopped his ouster from office
Wisdom Mwamburi Kazungu had moved to court seeking to stop the move by the county assembly to impeach him from office.
"A conservatory order is hereby granted restraining the 2nd respondent either by itself, a member, the 1st Respondent, any officer member of the secretariat or anyone whosoever from holding any elections, electing and appointing whether permanently or in an acting capacity any person to the position and the office of the speaker of the county Assembly of Taita Taveta until the next mention date hereafter," ordered Justice George Dulu.
Dulu further directed that the application be served for an inter partes hearing.
In his application, Kazungu listed the Clerk of the county assembly as the first respondent while the county assembly is second.
Also sued is Rose Shingira, a member of the Assembly.
The case is set for mention on Thursday, July 11.
In his application, Kazungu had asked the court to issue a permanent order restraining the county assembly, either by itself, a member, the clerk, any officer, member of the Secretariat or anyone whosoever from convening and/ or holding a session or taking proceedings to consider the subject of the removal of the Petitioner from the office of the Speaker of the County Assembly of Taita Taveta.
He also wanted the court to issue a permanent order restraining the respondents from holding any elections, electing and appointing whether permanently or in an acting capacity any person to the position and office of the Speaker of the County Assembly of Taita Taveta.
Kazungu also sought an order quashing the whole resolutions passed by the county assembly in the nature of removing him from office as the Speaker of the County Assembly of Taita Taveta.
