Court issues arrest warrant against Kisii county secretary

Plaintiffs returned to court after the County arbitrarily delayed compensating them.

A court in Kisii has issued a warrant of arrest against Kisii County Secretary James Ntabo.

The warrant was issued over the failure of the devolved unit to compensate three plaintiffs aggrieved by an illegal construction of a murram road on their land in Bassi Bointangare in Bobasi Sub-County seven years ago.

The Kisii environmental court Judge Hillary Nyamu had initially ruled that litigants - Elias Nyamari, Juvinalis Nyamweno and Joyce Buyaki- be paid a total of Sh373 500 for the trespass and subsequent destruction of their crops and trees during the incident.

The determination of the amount is cited in a ruling done in December 2021 at the Kisii Environmental Court.

OCS Kisii Central Police Station has since been instructed to effect the arrest by Tuesday next week in the decree issued on October 16.

In court papers, the plaintiffs had accused the County Secretary of sending 'his officers and tractors to make or create a new road to pass through their farms'.

During the said trespass, added to the charge, the tractor-trailer destroyed trees and crops.

The construction was said to be blatantly done without following the laid down regulations of compulsory compensation by taking away private land as required by law, stated the charge by the plaintiff.

In addition, they had, in their case sought a permanent injunction against the County by itself, its agents or servants and, or otherwise dealing with the property being land parcel numbers Bassi Boitangare 888 2182, 2009 respectfully.

Plaintiff Lawyer Samson Sagwe said the plaintiffs had suffered for far too long from the delay from the Defendant to compensate them.
