Transgender provisions in trade deals

When fudge is smeared, it’s hard to see beyond the mess. Reading the EU’s right of reply, by Guy Harrison (EU-Kenya trade: Getting the facts straight), to my article, one would think the EU wouldn’t dream of inserting transgender obligations into trade agreements. But it has.

Harrison cites the 2014 EU-EAC agreement, correctly denying it contains transgender provisions. But he cherry-picks agreements. The EU knows Kenya is a party to the EU-ACP (Africa, Caribbean, Pacific) post-Cotonou trade deal, initialled by Chief Negotiators in Brussels on April 15, 2021 (EU website https://ec.europa.eu).

Under review by Parliament, the deal contains transgender provisions. The EU-ACP agreement copy was provided by a press officer from the Spokesperson Service of the European Commission. It’s disingenuous to ignore the EU-ACP when responding on whether there are transgender provisions in trade agreements with Kenya.

Now, no one reasonable objects to transgender people living safely. There’s discussion on recognising a ‘third gender’ to give them a space and rights. However, that’s not what the West is doing. The West decided sex – male or female – is not important. What matters is their definition of ‘gender’ (yes it’s different) – you can be any gender you want. Gender “self-identification” means a man saying he is a woman is one. Even without sex-change surgery. Children choose genders. Adults play ‘let’s pretend a lie is true’.


This hurts transgender people as it effectively erases them, failing to give them a category. Hiding them in a category they don’t fit. But it hurts women most. Trans-legislation has effectively erased transgender and women as categories, pitted them against each other and increased the power of males without consultation, or majority support. What’s shocking is the capitulation of female politicians, terrified of the trans-lobby. They sold women out. As did NGOs, UN, WHO, EU, IOC and the West generally.

There are no safeguards on access to female spaces. In America, girls have been raped in toilets at school by boys wearing skirts “identifying” as female. Female toilets are no longer safe spaces. In UK prisons, women have been raped by male prisoners “identifying” as female, and a 10-year-old girl sexually assaulted in Morrisons supermarket toilet.

Such assaults on females are increasing and frightening. Males don’t need sex changes to access female spaces. So the West doesn’t really give a hoot about female safety or rights. They don’t care about fairness in women’s sport, jobs, or the right of women to a distinct identity.

Western women objecting to gender appropriation have lost jobs, been abused, ‘cancelled’, faced death threats, intimidated and silenced in the ugliest ways. Ask Harry Potter author JK Rowling. Allison Bailey, a black British lesbian founded the LGB Alliance against transgender activism and is suing an LGBT organisation.


In 2021, as bodies fell from planes, the Taliban silenced women. Simultaneously, the West cancelled women, as money for transgender lobbyists, backed by American billionaires, flooded in.

Terms like “mother” are offensive as they exclude transgenders. Freedom of speech for Western women does not exist. But space for men has increased, into women’s bathrooms, jobs, lives and sports (a man competed as a woman in the Olympics). Ironically, the EU-ACP talks about rights, respecting, consulting and giving women a voice. No one consulted Western women. Frauds.

So, where do Kenya’s women politicians stand? Will they stand? Maybe male politicians will just identify as women to get around the one-third gender rule.

Is the EU seriously denying there are transgender provisions in trade agreements with Kenya? Article 2 of the negotiated EU-ACP states, “The Parties shall systematically promote a gender perspective and ensure that gender equality is mainstreamed across all policies.” ‘Gender’ is used in place of ‘sex’. Looks innocent, but we know gender is not the same as sex for the EU. Gender may not correspond to the sex assigned at birth. Is Harrison alleging ‘gender’ is the same as ‘sex’ in the EU-ACP?

Harrison sniffled I’m not a trade expert. I and half my country are experts on being women. And we want an answer. Fudge anyone?
