How Naivas founder Peter Mukuha distributed his multi-billion wealth

Billionaire Kago wanted his ties to be given to church and the rest of clothing to family members.

A will left behind by Naivas supermarket chain founder the late billionaire Peter Mukuha Kago has laid bare how the tycoon wanted his wealth shared.

The family of Peter Mukuha Kago is embroiled in a property row, with one of his daughters seeking to be named administrator.

Numerous legal battles involving the children of the late Kago, the patriarch who died in 2010, have been lodged in court.

Disputes involving Naivas Limited shares and Kago’s estate have been in the courts since 2012.

Justice H.M Nyaga ruled on March 11, 2024, that the copy of the will was valid.

He noted that the administration of all the estate of the deceased which by law devolves to and vests in his representative was granted to David Kimani Mukuha and Grace Wambui Mukuha.

“Please note that this grant cannot be used to transfer any of the property of the deceased,” read part of the grant signed by Justice Heston Nyaga.

In the will, Kago wants his clothing to be given to family members except ties, which should be given to the church.

From the document, cash at Barclays Bank Ltd (now Absa), Naivasha branch will be divided equally among Teresia Njeri Mukuha, Grace Muthoni Mukuha, Ruth Wanjiru Mukuha, Newton Kagira Mukuha, Hannah Njeri Mukuha, Simon Gashwe Mukuha, Grace Wanjiru Mukuha, Linet Wairimu Mukuha and David Kimani Mukuha.

The will further said 20 per cent shares at Naivas Ltd will go to Simon Gashwe Mukuha (4 per cent), David Kimani Mukuha (4 per cent), Grace Wambui Mukuha (6 per cent) and Linet Wairimu Mukuha (6 per cent).

Linet Wairimu Mukuha will also get land, Plot No. 1/125 Kihoto.

Daniel Mukuha Njau would get Plot No.42 in Naivasha while Peter Mukuha Nyoro is entitled to land at Kampi ya Moto/Menegai Block 1/89.

David Kimani Mukuha, Grace Wambui Mukuha and Simon Gashwe Mukuha are to get Plot No. 121 Lake View Naivasha house No.1, House No2 and House No.3 respectively.

Cash at Barclays Bank Ltd Naivasha branch fixed account will be shared equally among Teresia Njeri Mukuha, Grace Muthoni Mukuha, Ruth Wanjiru Mukuha, Newton Kagira Mukuha, Hannah Njeri Mukuha, Simon Gashwe Mukuha, Grace Wanjiru Mukuha, Linet Wairomu Mukuha and David Kimani Mukuha.

Peter Mukuha Kago, Charles Mukuha Gashwe, Mercy Irene Waithera, Jane Wangui Kagira and Mercy Waithera will each get Sh500,000 from the Kenya Commercial Bank, Naivasha branch.

The balance at the Kenya Commercial Bank, Naivasha branch will be shared equally among Teresia Njeri Mukuha, Grace Muthoni Mukuha, Ruth Wanjiru Mukuha, Newton Kagira Mukuha, Hannah Njeri Mukuha, Simon Gashwe Mukuha, Grace Wanjiru Mukuha, Linet Wairimu Mukuha and David Kimani Mukuka.

Shares at Standard Chartered Limited will be sold and shared equally by Teresia Njeri Mukuha, Grace Muthoni Mukuha, Ruth Wanjiru Mukuha, Newton Kagira Mukuha, Hannah Njeri Mukuha, Simon Gashwe Mukuha, Grace Wanjiru Mukuha, Linet Wairimu Mukuha and David Kimani Mukuka.

Cash at Post Office Savings Bank will be shared equally by Teresia Njeri Mukuha, Grace Muthoni Mukuha, Ruth Wanjiru Mukuha, Newton Kagira Mukuha, Hannah Njeri Mukuha, Simon Gashwe Mukuha, Grace Wanjiru Mukuha, Linet Wairimu Mukuha and David Kimani Mukuka.

Motor vehicle Reg KBD 162 F will be given to Linet Wairimu Mukuha.

The will purported to have been left behind is subject to an appeal pending before a Nakuru Court.

Newton Kagira Mukuha in the appeal is questioning the validity of the will presented in court concerning the sub-division of his father’s estate.

Newton Kagira Mukuha, his sister Grace Wambui and brother David Kimani Mukuha have since filed applications at the Nakuru High Court seeking to be appointed administrators of the estate, in place of their brother Simon Gashwe, who died in August 2019.

Gashwe, the former chairman of Naivas Supermarkets, died in 2016 while undergoing treatment at the Aga Khan Hospital in Nairobi.

Gashwe, who owned 25 percent of Naivas's shares, was appointed sole administrator of the empire on May 6, 2010.
