Social Health Insurance Act: Public to give final views, Monday

Stakeholders and the public have a chance to give their final views on the proposed set of Social Health Insurance Act 2023 draft regulations.

This is after the Ministry of Health called for a national validation exercise on the draft regulations.

Health CS Susan Nakhumicha through a public notice published in the dailies said the exercise will take place on Monday, February 26 at the Kenyatta International Conference Centre (KICC).

This is after successful public participation forums were held across the country in January to give Kenyans a chance to input their views on the draft regulations.

The two sets of draft regulations for the Social Health Insurance Act of 2023 were developed in consultation with the board of the Social Health Authority.

The Social Health Insurance Act of 2023 which was enacted on October 19 gives the CS in consultation with the Social Health Authority the mandate to make regulations relating to various matters required to be prescribed under the Act.

They include the Social Health Insurance (General) Regulations, 2024 and the Social Health Insurance (Dispute Resolution Tribunal) Regulations, 2024.

“Following the successful public participation across the country, the CS and the board of the Social Health Authority shall hold a national validation exercise on the draft social health insurance (General) regulations, 2024, The social health insurance (dispute resolution tribunal) regulations, 2024 and the draft regulatory impact statement,” Nakhumicha said.

“We therefore invite all stakeholders and members of the public to participate in the national validation exercise scheduled for Monday, February 26 at KICC from 9 am,” she added.

The ministry has been conducting public participation on two sets of regulations after the court lifted orders against the implementation of the Social Health Insurance Act 2023.

In a public notice, Nakhumicha had called on Kenyans to submit their views on the regulations either through written memoranda or physical and virtual public participation meetings.

The regulations will guide the implementation of the Act.

“The object of these regulations shall be to set out the procedure to facilitate just, expeditious and impartial determination of complaints, disputes and appeals arising out of decisions made under the Social Health Insurance Act 2023,” Nakhumicha said.

The Social Health Insurance (General) Regulations 2024 will provide for the implementation of the Primary Healthcare fund, Social Health Insurance Fund emergency, chronic and critical illness Fund.
