Prime Cabinet Secretary Musalia Mudavadi has defended the legality of his position which is not entrenched in the Constitution.
Mudavadi in an interview with Citizen TV on Thursday night said he went through vetting like any other Cabinet Secretary thus there is no illegality in his position.
"No illegality was committed because as it stands, I am a Cabinet Secretary and the President can then assign you different roles. And I went through the process of vetting in Parliament. So we crossed that bridge way back," the Prime CS said.
The National Dialogue Committee in their report proposed the entrenchment of Mudavadi's office into the Constitution.
Responding on whether NADCO's recommendation to entrench the Prime CS in law was an admission of its legality, Mudavadi said:
"No, it is not an admission that there is an irregularity. There is no irregularity. I think society has got to be dynamic and as we go into the future, there is the whole debate about inclusivity of Kenyans and regions in terms of the leadership of a nation," Mudavadi said.
"So the debate that is still alive and continues is that do Kenyans feel that the Executive is too narrow and therefore the debate has been why not introduce and formalise the whole aspect of the office of a Prime Minister."
He said the same principle comes into play when it comes to the office of the official leader of the opposition
"That is why now there is a debate and recommendations that perhaps Kenyans made a mistake in trying to do away with the office of the leader of the opposition. And now that debate is back with us," he said.
On whether his role competes with that of Deputy President Rigathi Gachagua, Mudavadi said he is clear on what his role is in the executive.
He denied that his role competes with that of the Deputy President.
"The Executive order is very specific, that my role is to assist the President and the DP. I have been in public spaces for a very long time in terms of my experience. I know what the role of a DP is, the role of the President and I know how to manage my role as the prime CS," he said.
"So the issue of there was competition is neither here nor there. I have heard of the issues of competition and I have ignored it," he said.
