The court has ordered the reinstatement of former Central Rift Valley Water Works Development Agency chief executive Hosea Wendot who was expelled two years ago.
Wendot was removed in March 2021 and his place was taken by the general manager in charge of Technical Services, Samuel Oruma.
In his ruling, Judge Hillary Chemitei of the high court in Nakuru set aside the decision of the board and reinstated Wendot until the matter is heard and determined.
“That pending the hearing and determination of the main petition, this honourable court hereby suspends and stays the implementation of the decision of the board of management dated April 30, 2021,” reads the ruling.
“Consequently, the chief executive officer (Engineer Hosea Wendot) shall remain in office as the CEO of the 1st respondent with full salaries and all allowances and other benefits that the Board of Management’s operations is frozen.”
Wendot had moved to the court to challenge his ouster terming it unfair, illegal and unconstitutional.
He accused the board of failing to consider his “excellent” performance in service delivery at the helm of the board.
The agency, former Water CS, state advisory committee and three others had been named as the respondents.
Until his dismissal, his first term was nearing its end and the board was expected to sit after evaluating his performance.
The CRVWWDA was formed after the Rift Valley Water Services Board was disbanded.
Apart from CRWWDA, North Rift Water Works Development Agency was also formed by the former Water cabinet secretary.
