A Facebook post attributed to Chief Justice emeritus David Maraga on the ability of the Supreme court to declare the winner of the August 9, elections in case of a recount is fake.

The fake post also alleged that the former CJ was envisioning an arrest of Chebukati apparently because of an election irregularity.

"There are grounds that this election will be nullified or The Court can call for an open tally then finally announce the winner. I smell Chebukati arrest if it's true he was involved in electoral fraud!" the fake post stated.

It further stated:

"Funny question: How did DP William Samoei Ruto know that he's the Winner to call his mother to witness his victory? It is well let the Court decide! I'm watching and will give guidance Accordingly."

Fact-checker has however debunked the sentiments and found that they are fake.

The CJ has not said or posted such a message on his official media handles.

Maraga has also flagged the post and termed it fake.

Maraga served as the 14th chief justice and president of the Supreme Court of Kenya from October 2016 till his retirement in January 2021.
