Yassir Noor, the Jubilee candidate who lost the Nyali MP seat in the August 9 polls, has filed a petition in a Mombasa court.
He wants to quash the election of Mohammed Ali, who was reelected on the UDA ticket.
In his application through his two counsels David Masike and Yusuf Abubakar, Noor is seeking a court order for scrutiny, audit and a recount of votes in all polling stations in the constituency.
In the court documents, Noor argues that Ali, alias Jicho Pevu did not garner the highest number of votes and so was not rightfully elected to represent Nyali constituency.
Further, Noor asked the court to issue a declaration that election offences of a criminal nature occurred on election day.
These, he argues, warrant preference of charges against the Independent Electoral and Boundaries Commission.
Ali was first elected the MP for Nyali in 2017 as an independent candidate beating ODM’s Said Abdhalla.
Ali later joined President William Ruto's United Democratic Alliance on whose wave he rode to successfully retain his seat.
In the August 9 general election, Ali won the MP seat with 32,933 votes, beating all seven candidates.
His closest rival, Abdallah of ODM came second with 18,642 votes. Noor emerged fifth with 889 votes.
