Kakamega county assembly clerk Patrick Kamwessar has been sent on early retirement on grounds of corruption and incompetence
The County Assembly Service Board said it based its decision on the law, which empowers it to fire officials.
Members of the CASB said the assembly has remained ineffective since devolution took effect more than six years ago.
MCAs have complained the clerk made it impossible for them to get car loans and mortgages.
The board said Kamwessar had abused the values and principles of governance.
Following his removal, Laban Atemba was appointed as acting clerk. But Kamwessar has challenged the action in court.
He had been sent on compulsory leave last December for two months before it was extended for 30 more days.
Upon resumption of duty this month, Kamwessar was served with a letter signed by speaker Moses Buluma which read:
“This is to communicate the decision of the Kakamega County Assembly Service Board that you retire from service with immediate effect as per County Assemblies Services Act 2017 section 30 (4)."
Kamwessar, 57, said the decision was a violation of his rights.
