Football Kenya Federation (FKF) President Hussein Mohammed has secured yet another victory after a state agency found no irregularity in the Sh42 million insurance deal for CHAN 2024.
The Public Procurement Regulatory Authority (PPRA) said it had closed investigation into FKF’s insurance procurement as it was determined that it adhered to CAF regulations.
Equally, PPRA states that it has no jurisdiction to investigate the process as there we no public funds utilised in the subject procurement.
In a letter dated June 22, the PPRA informed FKF Acting CEO Dennis Gicheru said it took consideration that while FKF is inherently categorised as a public entity, it can only come under its scrutiny whenever public funds are used.
According to PPRA, the contested procurement insurance arrangements under which M/s Riskwell Insurance Brokers was engaged, was undertaken with the framework of the CAF procurement Guidelines funded through the CAF-controlled account.
“No public funds appropriated by Parliament, county governments or any Kenyan public entity were utilised in the procurement process. All funds utilised originated form CAF and were administered in accordance with CAF financial and procurement procedures,” PPRA director general Patrick Wanjuki said.
Wanjuki said FIFA statutes and CAF regulations require member associations to independently manage their affairs from third-party interference.
Furthermore, PPRA states that any attempt by a public regulatory body to suspend, review or direct procurement activities financed and governed by FIFA or CAF would be inconsistent with the obligations upon member associations under those frameworks.
“In light of the response provided, the authority finds that public funds were not utilised in the subject procurement. As such, the transaction is not governed by the Act, and the Authority has no jurisdiction to further investigate the concerns raised in the complaint. The authority has therefore proceeded to close this matter,” Wanjuki stated.
On April 24, the FKF president was temporarily suspended by the federation's National Executive Committee over the Sh42 million financial scandal linked to the 2024 CHAN tournament.
However, FIFA rejected the move as unconstitutional, and Hussein secured court orders blocking his ouster and remains in office.
FIFA reviewed the situation and rejected the suspension, stating that the NEC vote violated the FKF constitution as there was no fair hearing, proper agenda, or proof of a constitutional voting quorum.
The Sports Disputes Tribunal (SDT) has also since quashed the decision to suspend Hussein after declaring hat the procedure used was irregular.
