
The Law Society of Kenya (LSK), Busia Chapter, has asked the Chief Justice to urgently transfer Chief Magistrate Edna Nyaloti from the Busia Law Courts, citing safety concerns.
In a statement on Monday, LSK Busia Chapter Chairperson Dolan Nabulindo said the society is alarmed about the security of judicial officers in the county.
“The Law Society of Kenya, Busia Chapter, acknowledges the right to life as enshrined in our Constitution, a right we all cherish and defend. Equally, we are concerned with the safety of Chief Magistrate Nyaloti, and urgent intervention is necessary,” said Nabulindo.
She added that the situation has affected confidence in the safety and independence of the judiciary in Busia.
Following these concerns, advocates within the county have resolved to boycott proceedings before the court presided over by Nyaloti.
“If Chief Magistrate Nyaloti is not transferred within the next 21 days, advocates shall withdraw their services in all courts within Busia County, including the newly established Malaba and Port Victoria Law Courts,” Nabulindo stated.
Their concerns come after reports that unknown individuals allegedly approached Nyaloti’s residence at night and issued threats.
The magistrate has since written to both the Chief Justice and the Inspector General of Police, requesting investigations and enhanced personal security.
Nabulindo stressed that the LSK Busia Chapter remains committed to upholding the rule of law and safeguarding judicial officers.
“The transfer is not just about one officer’s safety, it’s about preserving the integrity and independence of the entire justice system in Busia,” she said.
The Office of the Chief Justice and the National Police Service are yet to issue an official response.
