The Sh40 million corruption case against Embakasi North MP James Gakuya resumes today with a hearing scheduled at the Anti-Corruption Magistrate's Court in Nairobi.

Gakuya was charged in 2018 with four counts of conflict of interest for allegedly awarding CDF tenders for road construction to companies linked to him.

The MP was charged alongside Cleophas Omariba Oyaro, Leah Waithera Guchu, and Richard Mwangi Chuchu.

Prosecutors say Gakuya and his co-accused misappropriated CDF funds in the award of tenders for the construction of the roads.

Gakuya and the CDF officials are facing charges of fraudulent acquisition of public property, conflict of interest, conspiracy to defraud and willful failure to adhere to procurement and disposal laws.

The case is being heard by principal magistrate Zipporah Gichana.

Mention of ex-Kiambu governor Waititu's case

Elsewhere at the criminal court, former Kiambu Governor Ferdinand Waititu is expected before Principal Magistrate Rose Ndombi for the mention of a case where he is accused of using offensive words against the state.

The charge sheet shows Waititu on September 29, 2024 at the Ruriru stadium in Kiambu county used abusive words, saying, ...I said, I said, even if we are cheated, I swear to God again, I swear to God, truly speaking to God, dogs are many more than we think."

Waititu is also accused of claiming that if the motion to impeach then Deputy President Rigathi Gachagua was debated and passed in Parliament, another seeking the removal of the President will also be introduced by Wiper leader Kalonzo Musyoka.

He denied the charges of offensive conduct and was released on a Sh50,000 bond.

Former Lamu Senator Loitiptip's case

Also to be mentioned is a case where former Lamu Senator Anwar Loitiptip is charged with Sh6 million fraud.

According to the charge sheet, it is alleged that on August 3, 2022, at Kileleshwa within Nairobi county, with intent to defraud, he obtained Sh6 million from one Samson Malonza by falsely pretending that he was in a position to sell him a motor vehicle of the make Toyota Land Cruiser V8, a fact he knew to be false.
