
The ruling on whether Ezekiel Muia Mutuku, alias Macho, who is charged with robbery with violence, will be released on bond or cash bail has been postponed to Tuesday, July 22, 2025.
This follows an affidavit opposing his release on bond or bail terms.
In the affidavit, CPL Johnes Nyangige, a police officer attached to the DCI Parklands, urged the court to deny the accused bond or bail until the case is concluded.
The affidavit further indicated that Mutuku is wanted at South B Police Station over a case of a similar nature. It also raised concerns that his release could interfere with ongoing investigations, as other suspects linked to the alleged offence are still at large and remain untraced.
Additionally, the affidavit argued that Mutuku might pose a flight risk due to the seriousness of the charges.
The prosecution told the court that investigators need more time to establish how the accused allegedly acquired police attire linked to the case.
"We pray that this honourable court denies the accused bail or bond until the determination of this matter," the prosecution submitted.
On his part, the defence counsel argued that Mutuku has a constitutional right to bond or bail.
The lawyer told the court that the accused is a family man who runs a reputable vegetable business and does not pose a flight risk.
Mutuku is accused of allegedly robbing Patel Kashyakumar Khantibhai of Sh999,000 while armed with a pistol, jointly with others, not before the court. He also faces a charge of possessing public stores contrary to Section 324 of the Penal Code.
It is alleged that at the time of his arrest, he was found with a cap peak, a white canvas cap cover, and a National Police Service crown badge, items suspected to have been stolen or unlawfully obtained.
Mutuku was arrested at a DTB Bank branch in Eldoret, where investigators claimed he and others were planning another crime. He is currently in custody at Parklands Police Station.
The court is expected to deliver its ruling on his bond or bail application on Tuesday, July 22, 2025.
