The Milimani Law Courts has released a woman who was charged with defrauding a Chinese investor over Sh13 million in a fake aluminium supply deal on a bond of Sh3 million or cash bail of Sh1.5 million.
Appearing before Magistrate Dolphine Alego on Monday, Harriet Mary Nabwire was charged with five counts before the Milimani Law Courts.
In the first count, the accused is charged with obtaining money by false pretenses, contrary to Section 313 of the Penal Code.
"You knowingly and fraudulently obtained USD101,284 from Li Zhongfu by pretending you were in a position to supply 50 tonnes of aluminium recycling material," the court documents read.
She is facing charges of falsely claiming she was in a position to supply 50 tonnes of recycling material for aluminium alloys, a claim the prosecution said she knew was untrue.
On the second count, she was charged with allegedly forging multiple documents in an attempt to execute the alleged fraud purporting to be of the Kenya Bureau of Standards.
On the third count, she is charged with allegedly forging a fake weight certificate with the same serial number purporting to be from the Kenya Bureau of Standards.
On the fourth count, Wabwire is charged with allegedly forging a certificate of conformity, also allegedly from the Kenya Bureau of Standards.
On the fifth count, she is facing charges of fraudulently making a bill purportedly issued by a leading shipping line.
The accused denied all the counts read to her before the court.
The prosecution side asked the court that they were not opposed to the bond and that the court could give them a bond.
The Counsel for the accused went ahead and told the court to consider giving them a lenient bail or bond terms.
"The accused before the court is not at flight risk and holds no passport, hence cannot abscond the court proceedings and therefore will tend to all the court wants."
The Counsel continued to state that the accused was a single mom of two minors, two years and seven years respectively, with special needs.
"In light of Article 53, I ask the court to consider the kids and release the accused to go take care of them.
The court released her on a bond of Sh3 million or a cash bail of Sh1.5 million.
The matter has been scheduled for a pre-trial on July 16, 2025, for directions.
