Two MCAs face legal action over theft and firearm misuse allegations

Two Members of County Assembly are facing legal scrutiny in separate cases involving theft and firearm misuse, raising fresh questions about accountability among elected officials.

In Nairobi, detectives arrested a Kitui county MCA on Tuesday afternoon in connection with the alleged theft of mobile phone accessories valued at approximately Sh1.9 million.

The items were reported missing on February 8 by a private courier service provider while reportedly en route to a client in Mombasa.

The Directorate of Criminal Investigations (DCI) confirmed that the arrest followed analysis of CCTV footage, which allegedly showed the suspect removing the parcel from the courier’s premises.

“The arrest followed a positive ID after CCTV footage of the scene was analysed, which recorded the suspect leaving with the parcel destined for a client in Mombasa,” the DCI stated.

The individual, who did not reveal his position as an elected official, was detained by the security personnel at the company’s River Road office before being handed over to Central police station.

“On being sighted at the River Road-based courier offices in Nairobi, the suspect was detained by the security personnel who then handed him over to police,” the DCI said.

“It was at the station that he was identified, and handed over to Mombasa detectives for further processing.”

In a separate case in Kajiado county, an MCA was on Thursday formally charged with three counts: misuse of a firearm, obstruction of a police officer, and creating a disturbance.

According to the DCI, the charges stem from a December 4, 2023 incident in Ngurunga, Emakoko, where police were attempting to arrest suspects involved in assault and malicious damage.

During the operation, the MCA allegedly intervened with a group of more than 10 people, some of whom were armed.

“The area MCA arrived with a group of more than 10 people armed with sticks and knives, who roughed up the unarmed officer guarding the arrested suspect and forcibly freed him,” the DCI reported.

The MCA is also accused of brandishing a pistol and confronting the police vehicle in which the arrested suspect had been placed.

“With a pistol at hand, the MCA also led the group to attack the police vehicle amidst threats,” the statement read.

Two armed officers at the scene, who had entered a nearby house to effect additional arrests, intervened to rescue their colleague and were able to repel the attackers.

The case was taken over by DCI Isinya, which later submitted the file to the Office of the Director of Public Prosecutions (ODPP).

The ODPP subsequently gave consent for prosecution.

“DCI Isinya took over the investigation and forwarded the case file to the ODPP, who cleared it for a prosecution process,” the agency said.

Both cases are under active investigation as law enforcement authorities continue to affirm their commitment to upholding the rule of law, irrespective of an individual’s public standing.
