Man handed 3-year jail term for vandalising road infrastructure

A man in Mombasa has been sentenced to three years or ordered to pay Sh3 million for vandalising road infrastructure.

The Kenya National Highways Authority (KeNHA) said the man was arrested for removing reinforcement bars along the Miritini – Kipevu Road in Mombasa county.

In delivering the sentence, the court also took into account Tsuma’s prior conviction for a similar offence in 2023, for which he had been sentenced to community service.

In a statement on Friday, KeNHA said his actions violated Section 24 of the Scrap Metal Act (Act No. 1 of 2015).

The authority condemned the vandalism of road infrastructure, as it endangers the safety of road users and affects the durability of road pavements.

“As an Authority, we urge all Kenyans to protect road furniture and report any acts of vandalism to our offices or the nearest police station,” KeNHA said.

The Authority called on Kenyans to be keen and protect the infrastructure for safety purposes.

KeNHA is a statutory body established under the Kenya Roads Act of 2007 and inaugurated in September 2008.

It is responsible for the development, rehabilitation, management and maintenance of all National Trunk Roads comprising of Class S, A, and B roads.

It is headquartered in Nairobi and has ten regional offices and three corridor management offices.

KeNHA was certified ISO 9001: 2008 in July 2013 and was recertified to ISO 9001: 2015 in September 2018.

It is also in charge of all weigh bridge installations.

Kenya National Highways Authority have recently expressed concerns about the escalating issue of vandalism, particularly of road signs. 

The Kenya Roads Act, 2007 provides the legal framework for dealing with vandalism of road infrastructure. 

Section 49 addresses structures and other works on, over, and below roads or certain other land, requiring written permission from the responsible authority.
