EACC recovered Sh6.63bn proceeds of crime in financial year 2022/23 – report

It completed 40 asset-tracing inquiries in respect of illegally acquired and unexplained assets.

In the financial year 2022/23, the Ethics and Anti-Corruption Commission traced and recovered Sh6.63 billion in proceeds of crime, a report has shown.

The report for the mentioned period was launched and released on Tuesday, May 14.

"The Commission completed 40 asset-tracing inquiries in respect of illegally acquired and unexplained assets," it stated.

The report highlighted some of the 12 assets traced including Sh2,324,000,000 traced from an allegation of irregular review of grants of 11 parcels excised from Moi International Airport, Mombasa to East African Gas Company Limited.

It also traced and recovered Sh1.6 billion in an alleged fraudulent acquisition of public property in Nakuru and Sh1.2 billion in an alleged irregular acquisition of public land belonging to the Agricultural Training Centre in Nakuru by private developers.

The FY2022/23 annual report added that the Commission also recovered Sh370 million in alleged irregular alienation of public property to Red Bridge Farm Limited in Kwale County.

Further, an allegation of unexplained wealth against the former Kisii County Chief Officer led to the tracing and recovery of Sh320 million.

EACC also recovered Sh305 million from private entities who had allegedly, illegally demarcated/alienated public land belonging to Marine National Reserve, Kenya Wildlife Service.

The Commission stated that there had been issuance of titles for four parcels, to the entities.

It also recovered Sh143 million belonging to the Kenya Revenue Authority following an allegation of unlawful alienation of the KRA staff quarters on a parcel of land situated in Kizingo Area in Mombasa County.

Further, an allegation into irregular acquisition of public land Ngei Estate Block, Machakos County, resulted to the recovery of Sh110 million while in Homa Bay County, Sh104 million was recovered in an alleged payment of multiple salaries to former and current employees of the County.

EACC also recovered Sh55,090,860 in the alleged misuse of public funds by officials of Isiolo County, through irregular payments to an individual's personal account over the period 2018 to 2022.

It also traced and recovered Sh50 million in alleged irregular acquisition of public property by former chairperson of a school in Trans Nzoia County and an additional Sh50 million in an allegation of irregular acquisition of public utility land by a church in Kajiado County.

They reported that in the period under review, the Commission filed 23 applications for preservation of assets valued at approximately Sh886 million.

"Preservation and injunctive orders were granted for the applications," it added.

In the same period, the anti-corruption body also filed 62 recovery suits with an estimated value of Sh8.73 billion.

Additionally, illegally acquired and unexplained assets valued at approximately Sh3.8 billion were recovered through court proceedings and out-of-court settlements.

The report added that during the year under review, 62 cases on corruption, economic crimes and unethical conduct were finalised in court.

Out of these, 27 were convictions, 27 were acquittals and eight were withdrawals.
