Businessman accused of issuing bad cheque released on Sh400,000 bond

The state has listed six witnesses against the accused.

A businessman has been charged at Kibera Law Court with three counts of issuing a bad cheque contrary to the law.

John Malogo Nderitu was charged that on April 16, 2016, at Granada Trading Company offices in Twiga Towers in Nairobi, issued a cheque for Sh999,000 of NIC Bank in favour of Rajendra Sanghani knowing that the said account had insufficient funds.

Appearing before Senior Principal Magistrate Samson Temu, Malogo also faced another count of issuing a bad cheque on April 26, 2016, at the same venue, to the same person.

"John Malogo Nderitu on May 17, 2024, at Granada Trading Company Office in Twiga Twin Towers within Nairobi County issued a cheque number 000665 of Sh999,000 of NIC Bank Karen branch in favour of Rajendra Sanghani on Subaru Motors Limited, knowing that the said account had insufficient funds," a charge sheet read further.

The accused however denied the charges and requested for release on lenient bail/bond terms.

The defence lawyer said his client is willing to comply with measures to be set by the court.

"My client is willing to comply with the rules to be set by this court hence I beg for lenient terms," he pleaded.

The prosecution did not oppose his prayer.

He was released on bond of Sh 400,000 with a surety of the same amount or alternative cash bail of Sh 100,000.

So far, the state has listed six witnesses against the accused.

The matter will be mentioned on April 13, 2024, for pre-trial and directions.
