The court has affirmed that the first accused person knew Monica Kimani prior to her death.

Jowie had claimed he did not know Monica before her death.

Justice Grace Nzioka said the issue arose because the evidence of the first accused person is, that he did not know the deceased at all prior to her death. 

"It is the finding of this court, that the evidence by the first accused person that he did not know the deceased prior to her death is untenable, insincere and it is an afterthought and it is false," Justice Grace Nzioka said.

"The court finds that the first accused person was known to the deceased because they were together at Kenya Polytechnic. They were in the same class taking the same course."

Justice Grace Nzioka also said that evidence shows Jowie Irungu stole an ID belonging to Dominic Bisera two days before the murder of Monica Kimani.

Nzioka said he used it to access the victim's house (Monica).

Dominic whose ID was stolen lost it on September 17, 2018, when he went to Royal Park Estate to look for casual work.

The main gate requirement was to leave your identity card at the gate and collect it in the evening after work.

The Judge also affirmed that the death of Monica Kimani is a clear case of homicide.

As she read out an analysis of Monica's cause of death, Nzioka said the prosecution had proved that the death was unlawful.

The Judge said the court relied on evidence from an examination by a doctor.

The judgment had been adjourned twice with the last time Maribe's advocate Katwa Kigen indicating to the court she was unwell.

Monica’s body was found at her Lamuria Gardens Apartment which is located on Kitale Lane off Denis Pritt Road in Kilimani.

The two have been on trial since 2018, with the prosecution calling 35 witnesses. The defence did not call any witnesses.
