Man gets 12 years jail-term for subjecting daughters to FGM

The 45-year-old was found guilty of taking his three daughters to undergo the cut.

A man has been sentenced to 12 12-year jail term after he was found guilty of three counts of Female Genital Mutilation.

He committed the offence on diverse dates between January 1, 2023, and January 20, 2023, at Vipingoni in Lamu.

The court heard that the 45-year-old took his three daughters to Boni Forest to undergo FGM.

The three were aged 12, five and four years old.

State led by Prosecution Counsel Wambua Kyalo presented six witnesses to support its case against the accused person.

After his conviction, the court sentenced him to serve four years' imprisonment for each count, totalling to 12 years.

Delivering the judgment, Mpeketoni Senior Resident Magistrate Pascal Nabwana gave him an alternative of paying Sh600,000 in fine.

The man had been arraigned on the charges of aiding and abetting FGM contrary to Section 20 as read with Section 29 of the Prohibition of Female Genital Mutilation Act 2011.

Section 20 states that, "A person who aids, abets, counsels or procures— (a) a person to commit an offence under section 19; or (b) another person to perform female genital mutilation on that other person, commits an offence"

While Section 29 of the Act reads, "A person who commits an offence under this Act is liable, on conviction, to imprisonment for a term of not less than three years, or a fine of not less than two hundred thousand shillings, or both".

FGM was outlawed in 2011.

This has however not deterred individuals from practising it, with many young girls and women still being subjected to the cut.
