The High Court will today deliver its judgment on the petitions seeking nullification of the Finance Act 2023.

Various petitions were filed challenging the Act that came into force on July 1 before Justice Mugure Thande issued conservatory orders suspending its implementation.

Chief Justice Martha Koome then named justices David Majanja (presiding), Christine Meoli and Lawrence Mugambi to form a bench to hear the petitions.

That was after the Court of Appeal lifted Justice Mugure Thande's orders and allowed the Act to become operational.

After a day-long hearing on September 13, the judges said they would deliver their judgment on November 24.

They promised to consider all the written and oral submissions.

Lawyers for the petitioners led by Otiende Amollo urged the court to nullify the Act saying several clauses included in it were illegally introduced.

But lawyers representing Treasury CS Njuguna Ndung'u and the Attorney General opposed such bids and urged the court to dismiss the petitions.

Senior Counsel Githu Muigai said the petitions were more like a political dispute that was presented before the court to create chaos in a democracy.
