DPP ordered to charge Indian man, his mother over wife's death

The Magistrate said that a pathologist tried to cover up the murder.

Vanitah Nikesh who died on April 3.

After days of hearing an inquest case, a Kibera court has directed that a husband and his elderly mother be charged with the death of his late wife Vanitah Nikesh who died on April 3. 

While reading her ruling on the verdict, Kibera Senior Principal Magistrate Electina Rihany said that the late was murdered, ruling out any possibility of suicide.

The Magistrate said that a pathologist tried to cover up the murder.

Rihany directed that the said pathologist be investigated.

In the said inquest, Nikesh Senghani was questioned over the main cause of his wife's death.

His wife was found dead at their house. Her body was found in a kneeling position facing outside the window, court photos and exhibits show.

The Magistrate further directed that the husband and his elderly mother Debai Senghani be charged with murder.

The court ruled that they were in one way or another linked to the death of 27-year-old Nikesh.

It's now upon the DPP to check the court's proceedings and recommend as advised.

According to the court proceedings,  Nikesh’s body was found by her mother-in-law and some neighbors.

The neighbors told the court that a piece of cloth was found around her neck at house number one of Block 1, at the Swaminarayan Temple flats, along the Southern bypass, off Langata road.

While giving her a more detailed ruling, Riany emphasized that it was clear Nikesh's death was abnormal.

 "It is clear that this was not a normal death and there was a lot of cover-up going on in the case meaning there was foul play," she said

"Nikesh Senghani and his mother Debai Harji Senghani are hereby found liable for the death of Vanita and the DPP should now take necessary action against them in accordance with the law,” said Riany.

She added that Nikesh mother of mother was not honest in her accounts of what occurred in her court testimonies.

"She was not being honest. She claimed that she accessed the deceased through her bedroom window but upon scene visit it was found that the window was too high for her to reach,” said Riany.

The Magistrate wondered why the body was quickly disposed of.

“For the record,  it is suspicious why they were quick to dispose of the body," she said.

Nikesh during her testimony in court said they had normal couple disagreements.

She said she left her okay in the house only to be told later that she had hanged himself.
