City contractor charged with assaulting female employee

A contractor who allegedly beat up his female employee he accused of colluding with another worker at a construction site in South B, Nairobi, to demand undue compensation was Tuesday charged with assault.

Davendra Keshra is accused of assaulting Sharon Beywa at the South B shopping centre in Nairobi on October 15, 2020, contrary to section 251 of the Penal Code.

He denied the charges before Principal Magistrate Caroline Mugo of the Makadara Law Courts.

Keshra was released on a cash bail of Sh15,000.

The case will be mentioned on December 8 before the hearing starts on April 11 next year.

Keshra is accused of attacking the complainant who is a safety health officer at his company after a disagreement over compensation of an injured employee at the construction site.

According to investigations, Beywa had arrived at the site to find Keshra in an argument with an employee she had escorted to a hospital after he was injured while on duty at the same site.

The worker had been told by medics to take a rest out of work for some time owing to the treatment he was undergoing, which the suspect allegedly did not like because he was paying him despite being out of work.

Keshra summoned her to the point where they were arguing over claims the employee was demanding.

Police investigations show the accused person was lamenting that he was paying the injured worker who was not working because Beywa had told the worker to ask for payment from him.

Keshra demanded receipts to prove the injured worker was demanding the exact amount of money that he had spent to commute to the hospital after the injury but he and Beywa could not get them because most matatus in Nairobi don’t issue receipts to passengers.

The argument got out of hand and Keshra allegedly started hurling insults at Beywa and the complainant left the scene and went to her office.

Statements recorded show while at her office, the accused person stormed in and allegedly punched her on the cheeks.

The suspect grabbed two chairs to hit the complainant but another worker who was there intervened and restrained Keshra from further assaulting Beywa.

The complainant later noticed that she was bleeding and the suspect left threatening to sack her.

Beywa sought treatment and continued working until she left the company.

In September this year, the complainant’s jaw which had healed developed complications and she went to a hospital for further treatment where she was told she had soft tissue injuries that had not healed well.

She later reported the matter at the South B police station as she continued with treatment and police started investigations into the matter.

Beywa told the police that she feared reporting the matter at the time when the incident happened because she feared for her job.

The suspect was later arrested after investigations.
