Worldcoin is not registered to operate in Kenya – Muturi

Worldcoin has been operating in the country illegally, Attorney General Justin Muturi has said.

Muturi told the Ad hoc committee inquiring into its activities that Worldcoin is not registered as a business company for it to operate as required.

"Chair, from the information that we have, the name Worldcoin does not appear in the BRS database as a registered business company," he said on Wednesday.

"This is contrary to the law which provides that all foreign companies must obtain registration." 

Similarly, he added, Tools for Humanity, a German-based company that is an affiliate of Worldcoin is also not registered as a business company locally.

He, however, stated that only the Sales Marketing company, another subsidiary is fully registered.

Muturi was appearing before the Committee chaired by Narok West MP Gabriel Tongoyo to provide the legal status of the project in accordance with the Kenyan laws.

Sales marketing was registered in 2013 under Kevin Odumbe with its offices located at LR 209/37 Langata/Kitengela Road.

Under section 974 of the Companies Act of 2015, he noted, a foreign company shall not undertake any business in Kenya unless registered in accordance with the provisions of the Act.

Consequently, Tools for Humanity (Germany) and Tools of Trade (US) submitted their applications on August 22 to the office of the Data Commissioner for registration as data processors which was approved.
