A Nairobi Court had declined to withdraw charges against a couple who had been charged over the SGR compensation scandal.

The DPP had made an application seeking to drop charges against David Some and Esther Chebet alongside their companies.

However, Magistrate Eunice Nyutu declined to withdraw the charges saying its an abuse of the court process.

In the case, the two had been charged alongside former NLC boss Mohammed Swazuri.

It was alleged that they were paid Sh221,375,000 by NLC on behalf of Kenya Railways Corporation for the construction of SGR.

In his application to the court, the DPP had claimed that he received information regarding the matter in court that necessitated the review of the evidence.

So far a total of 24 prosecution witnesses have testified against the accused persons.
